Company under the business name E-Commerce Capitals spółka z ograniczoną odpowiedzialnością sp. k. seated in Poznań (Poland), Matejki st. 6/7, 60-766 Poznań (Poland), entered into the Register of Entrepreneurs under the National Court Register number 0000592712, whose files are kept by the District Court Poznań Nowe Miasto and Wilda in Poznań, 8th Economic Department of the National Court Register, that uses tax identification number (NIP): 7792439665 and REGON statistical number: 363746333, hereinafter referred to as ‘Company’ or ‘Administrator’, fulfilling the obligation specified in art. 12 sec. 1 of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR), hereby presents this information, asking whoever it may concern to get acquainted with it.

Categories of personal data subject to processing and information on the freedom to provide them
- The Company is the organizer of the E-commerce Germany Awards, hereinafter referred to as ‘Contest’. Whoever wants to submit a solution to the Contest (hereinafter referred to as ‘Participant’) must provide the following personal data:
- name,
- last name,
- email address,
- job position and represented brand (the company of the employer or their own company),
- phone number,
- website address,
- materials provided as part of the submission (descriptions, assets, public information).
- During Stage II of the Contest — Online Voting — individuals who vote (hereinafter ‘Voters’) must provide:
- email address,
- LinkedIn profile identifier (if applicable).

Provision of personal data is voluntary. However, unless they are provided, it will be impossible to submit an entry to the Contest.

With regard to Online Voting, provision of personal data is voluntary. However, unless they are provided, it will be impossible to vote in the Contest.
Purposes for which personal data are processed
- The personal data mentioned in point 3 above serve exclusively the following purposes:
- to register, verify and administrate submissions to the Contest,
- to verify that Voters are real individuals and ensure the security of the Online Voting process,
- to realise communication related to the Contest,
- to realise direct marketing activities for Administrator’s services – email communication related to the current and subsequent editions of the Contest and the E-commerce Berlin Expo & Conference,
- to send information and invitations regarding future editions of the Contest for up to 10 years,
- to promote the Contest, including its Finalists and Winners, in social media.
Handing over of personal data

We hand over the following personal data of Participants to Jury members evaluating entries in the Contest:
name, last name and represented brand (the company of the employer or their own company). -
Handing over of data mentioned in point 7 consists in providing Jury members with access to an application which contains the above-mentioned data of Participants for the purpose of evaluating entries. Jury members have no access to Participants’ email addresses.
During the Contest, company names and submitted descriptions may be published publicly as part of Online Voting and promotional communication.
Email addresses are not accessible to Jury members or third parties.
Legal basis for personal data processing

The Administrator informs that Participants’ personal data are processed for purposes mentioned in point 1) and 2) above, under art. 6 sec. 1 (b) of GDPR, that is, exclusively to execute the agreement between the Administrator and the Participant that is concluded during submission on the Contest website. Terms of the agreement are specified by the Contest’s Terms & Conditions.

The Administrator informs that personal data are processed for the purposes mentioned in point 4) and 5), under art. 6 sec. 1 (f) of GDPR, that is, in the legally justified interest of the data Administrator, which is direct marketing related to the current and subsequent editions of the Contest and the E-commerce Berlin Expo & Conference.
The period of personal data processing

Personal data of Participants will be processed for purposes mentioned until the Contest is concluded.

Personal data processed for marketing purposes — including communication regarding subsequent editions of the Contest — will be processed for up to 10 years, or until the data subject opposes data processing.

Data of Finalists and Winners may remain publicly available as a part of Contest archives.

The rights of people whose data we process

Every person whose personal data we process has the right to file a complaint about our actions or negligence to the supervising body, that is, the President of the Personal Data Protection Office (PUODO). The Office is located at ul. Stawki 2, 00-193 Warsaw.

Every person whose data we process has the right to obtain confirmation from us whether their personal data are processed and, if this is the case, they are entitled to acquire access to the data and obtain information included in this document.

Every person whose personal data we process has the right to demand that we immediately correct the data that are incorrect. Considering the purposes of processing, the person whom given data concern has the right to demand to complement incomplete personal data.

Every person whom the data concern has the right to ‘be forgotten’, meaning we will remove their personal data immediately, provided that:
- the personal data are no longer essential for the purposes mentioned in point 5 above,
- the person withdraws consent (if applicable),
- the person opposed processing (see point 21 below),
- the data are processed illegally,
- the request results from an obligation under EU or Polish law,
- personal data were acquired as a result of offering information society services to a person under 18.
- The person whom the data concern has the right to demand that we restrict processing in the following situations:
- the person questions correctness of personal data,
- the processing is illegal and the person opposes to their removing,
- we do not need the data anymore but the person needs them for claims,
- the person opposed processing until we verify whether our legally justified grounds override theirs.

The person whom the data concern has the right to receive from us – in a structured, commonly used, machine-readable format – their personal data and send them to another administrator, or request we send them directly, if technically feasible.

We process the accumulated personal data for the purpose of direct marketing, so the person whom the data concern has the right to oppose – at any time – to processing of their personal data for the purpose of direct marketing. In such a case we will immediately cease processing their personal data for this purpose.
